¶ 01 Hon. Presiding Member, I move the following amendments:

¶ 02 (1) "On page 21, delete from line 14 to line 23 (both lines inclusive) and substitute:

¶ 03 '(1) In subsection (2) of that section— (a) in paragraph (b), for the words “a date not later than two years thereafter”, substitute the words “a date not later than one year thereafter”; (b) in paragraph (c)— (i) for the words and figures “items (d), (e) and (f)(ii) of paragraph 1 of the Schedule”, substitute the words and figures “items (a), (b), (c), (d) and (e)(ii) of paragraph 1 of the Schedule”; (ii) for the words from “may be removed:” to the end of that paragraph, substitute the words “may be removed.”; and'"

¶ 04 (2) "On page 22, immediately after line 3, insert:

¶ 05 '(ba) in subparagraph (ii) of paragraph (e), for the words “obligations under the Employees’ Provident Fund”, substitute the words “obligations under the Employees’ Provident Fund and the Pension Fund”;'"

¶ 06 (3) "On page 22, delete line 9 and substitute:

¶ 07 'by;'"

¶ 08 (4) "On page 22, immediately after line 9, insert:

¶ 09 '(bb) in paragraph (u), for the words “the sources of funds shall be identified.” substitute the words “the sources of funds shall be identified;”; (bc) immediately after paragraph (u), insert the following new paragraph:- (ua) Within a date not later than one year from the date of publication of the Final Vesting Plan in the Gazette, all officers and employees holding office in the Generation Company referred to in item (a) of paragraph 1 of the Schedule shall— (i) be duly identified by the Generation Company; (ii) within four months from the date of publication of the Final Vesting Plan in the Gazette, be notified by the Generation Company of their proposed secondment to the relevant subsidiary companies referred to in item (e)(i) of paragraph 1 of the Schedule; and (iii) within two months from receipt of the notice referred to in subparagraph (ii), inform the Generation Company whether or not they opt to be seconded to the relevant subsidiary companies referred to in item (e)(i) of paragraph 1 of the Schedule. They shall thereafter be seconded, with effect from a date falling after one year from the date of publication of the Final Vesting Plan in the Gazette, to the relevant subsidiary companies referred to in item (e)(i) of paragraph 1 of the Schedule under terms and conditions not less favourable than those enjoyed by them as at the date immediately prior to the appointed date under their contracts of employment with the Ceylon Electricity Board. Any employee who does not opt to be seconded to a subsidiary company referred to in item (e)(i) of paragraph 1 of the Schedule under the Final Vesting Plan shall be entitled to a voluntary retirement scheme, the terms and conditions of which shall be determined within four months from the date of publication of the Final Vesting Plan in the Gazette; and (ub) Within a date not later than one year from the date of publication of the Final Vesting Plan in the Gazette, all officers and employees holding office in the Distribution Company referred to in item (b) of paragraph 1 of the Schedule shall— (i) be duly identified by the Distribution Company; (ii) within four months from the date of publication of the Final Vesting Plan in the Gazette, be notified by the Distribution Company of their proposed secondment to the relevant subsidiary companies referred to in item (e)(ii) of paragraph 1 of the Schedule; and (iii) within two months from receipt of the notice referred to in subparagraph (ii), inform the Distribution Company whether or not they opt to be seconded to the relevant subsidiary companies referred to in item (e)(ii) of paragraph 1 of the Schedule. They shall thereafter be seconded, with effect from a date falling after one year from the date of publication of the Final Vesting Plan in the Gazette, to the relevant subsidiary companies referred to in item (e)(ii) of paragraph 1 of the Schedule under terms and conditions not less favourable than those enjoyed by them as at the date immediately prior to the appointed date under their contracts of employment with the Ceylon Electricity Board.
